LAHORE — On Tuesday, the Lahore High Court (LHC) postponed an order issued by the Election Commission of Pakistan (ECP) to decertify 43 leaders of the Pakistan Tehreek-e-Insaf (PTI) as National Assembly members (MNAs).
Justice Shahid Karim issued his decision on the petitions brought by PTI legislators, who named National Assembly Speaker Raja Parvez Ashraf and the ECP as respondents. The court has also ordered that no by-elections be held in the seats until further rulings be issued.
During the session, PTI lawyer Ali Zafar claimed that the legal prerequisites for accepting the MPs’ resignations had not been met. When Justice Karim asked what type of standards were overlooked in the process, Mr Zafar said that the NA speaker had violated the Constitution by failing to undertake an investigation before accepting the resignations. He said that under the law, the speaker could not accept them without first listening to the MPs’ complaints.
